JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-01-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.
This is an application for grant of anticipatory bail in connection with Complaint Case No. 413C of 2016 registered for the offence punishable under Sections 420, 467, 468 and 323 of the Indian Penal Code.
The allegation against the petitioners is that they had formed a committee of which the petitioner No. 1 is said to be the Chairman and subsequently, some money was taken from the Government. It is further alleged that in the name of charity and under the garb of the said Mahila Sansthan, the petitioners got a
Patna High Court Cr.Misc. No.62170 of 2017 (3) dt.11-01-2018 2/2 sale deed registered in favour of the petitioner No. 1 fraudulently, which belongs to the informant.
The learned counsel for the petitioners submits that the said land has been registered in favour of the petitioner no. 1 after payment of full consideration money, hence, at best, the allegations levelled in the complaint petition constitutes a civil wrong and the appropriate remedy for the informant lies before a competent court or civil jurisdiction.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners above named, in the even of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M, IV, Bettiah, West Champaran in connection with Complaint Case No. 413 C of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
