JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2018 The petitioner is apprehending his arrest in connection with Bairiya P.S. Case No. 173 of 2017, registered for offences punishable under Section 379 of the Indian Penal Code. Allegation against the petitioner is of commission of theft of motorcycle of the informant.
It has been submitted on behalf of the petitioner that he has been made accused in this case only because he was found wandering at the place of occurrence and except that there is nothing against the petitioner.
Learned counsel for the State opposed the prayer for bail on the ground that the petitioner himself had admitted that the said motorcycle will be returned to the informant. Having heard both sides, considering the facts and
Patna High Court Cr.Misc. No.31984 of 2018 (3) dt.27-06-2018 2/2 circumstances of the case and nature of accusation, I am not inclined to grant the privilege of anticipatory bail to the petitioner. this application is accordingly dismissed.
Petitioner, if so desire, may surrender before the court below and pray for regular bail and if any such application is filed the same will be considered on the merit of the case, without being prejudiced by the order of this Court.
