====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 30-04-2019 Heard learned counsel for the petitioners and the State.

The petitioners seek bail in Narpatganj P.S. Case No. 442 of 2015, instituted for the offence under Section(s) 302/34 of Indian Penal Code.

It is alleged in the written report that on the date of occurrence the informant had gone to house of Brahamdeo Yadav but he did not return. The informant along with others went to the house of Brahamdeo Yadav and saw in the torch light that her husband was tied with rope. The informant identified the petitioners and other accused persons. In this manner, from the allegation it appears that

Patna High Court CR. MISC. No.27965 of 2019(2) dt.30-04-2019 2/2 mere suspicion has been raised against the petitioners. Counsel for the petitioner submits that petitioner Nos. 1 and 3 are in custody since 14.12.2018 petitioner No. 2 is in custody since 22.12.2018.

Counsel for the petitioners submits that other coaccused have already been granted bail by coordinate Benches of this Court vide orders dated 3.5.2017, 14.11.2017 and 28.2.2018 passed in Cr. Misc. 20507 of 2017, 52535 of 2017 and 51703 of 2017 respectively.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Narpatganj P.S.
