JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-07-2018 The petitioners seek bail in anticipation of their arrest in connection with Shahpur Patori(Mohanpur O.P.) P.S. Case No. 378 of 2017 instituted for the offences under Sections 323, 324, 341, 354, 379, 34 of the Indian Penal Code. It has been submitted on behalf of the petitioners that because of the wife of the petitioner No. 1 having filed a complaint case against the informant, the present case has been lodged.
Considering the nature of allegation and the fact that the petitioners are neighbours of the informant, they, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today are directed
Patna High Court Cr.Misc. No.32911 of 2018 (3) dt.02-07-2018 2/2 to be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Shahpur Patori (Mohanpur O.P.) P.S. Case No. 378 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. While saying so, this Court has also taken note of the fact that the injuries suffered by the informant and others are simple in nature.
