The petitioner is apprehending his arrest in connection with Rajeev Nagar P.S.Case no.385 of 2015 registered for offences punishable under Sections 147, 148, 149, 387, 341, 323, 324, 504, 506, 307, 302, 448, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
Earlier the prayer for bail of the petitioner was rejected, vide order dated 21.9.2017 passed in Cr. Misc. No.46655 of 2017. Submission of the learned counsel for the petitioner is that he is aged about 75 years old and during investigation except being kingpin, there is nothing against the petitioner and he has been falsely implicated in this case due to enmity. Heard learned A.P.P. also.

No.37373 of 2018 (4) dt.16-07-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail before the learned court below, who will consider the age of the petitioner and also materials available against him and will pass appropriate if possible on the same day.
