JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 12-08-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State through Video Conferencing. The petitioner has preferred this application for grant of regular bail in a case registered u/ss 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, Rs. 1 lacs kept in bag was robbed by the three unknown miscreants who were boarded on motorcycle and they were apprehended by the villagers. They disclosed their names as Md. Parwej (the petitioner), Md. Saifullah and Md. Gulab. The said amount of Rs. 1 lacs was recovered from them.

Nothing has been recovered from the conscious possession of the petitioner. The petitioner is also accused in two other criminal cases as stated in para 3 of the bail petition. Learned counsel for the petitioner has further submitted that the co-accused has already been granted bail by this Court vide order dated 22.07.2022 passed in Cr. Misc. No. 17160 of 2022. As per the impugned order, the petitioner is in custody since 28.08.2021.

Learned A.P.P. for the State has opposed the bail petition of the petitioner by submitting that the petitioner was apprehended on the spot.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-1, Benipatti, Distt,-Madhubani, in connection with Bisfi P.S. Case No. 195 of 2021.

The application stands allowed.
