The State of Bihar .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 23-11-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 148, 149, 323, 341, 337, 338, 353, 332, 427, 435, 504 and 307 of the Indian Penal Code and Se4ctions 3 / 4 of the Prevention Damage of Public Property Act. Allegation against petitioners is that they were members of the mob, who had blocked the road demanding to hand over arrested Vinod Singh. When police left the place with Vinod Singh, the mob started brick batting and set a police jeep on fire. It has been submitted on behalf of the petitioners that they have got no criminal antecedent.

No allegation of tampering of witnesses is alleged against petitioners. No specific allegation has been made against petitioners. General and omnibus allegation has been made. Altogether 45 persons have been named in the F.I.R. and others 150 are unknown persons. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the

Patna High Court Cr.Misc. No.50215 of 2016 (2) dt.23-11-2016 2/2 court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Bhabua (Sonhan) P.S. Case no. 571 of 2016, G. R. no. 2430 of 2016 , subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
