====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 13-12-2021 Learned counsel for the petitioner seek permission to rectify the pleadings made in para 1 of the bail application. Permission is accorded.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Forbesganj P.S. Case No. 101 of 2021, registered under Sections 457 and 380 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.02.2021, and is a person of clean antecedent and charge-sheet has been submitted, allegation is that a theft was committed in the house of the informant by unknown person and article as detailed in the F.I.R., were stolen, accordingly, F.I.R. was instituted against the

Patna High Court CR. MISC. No.38201 of 2021(2) dt.13-12-2021 2/2 unknown and the name of the petitioner transpired on the basis of investigation of CDR of stolen mobile bearing no. 8669999222, from which it transpires that the petitioner received call from the said mobile.

Learned counsel submits that petitioner has no concern with the alleged offence, nor any incriminating articles has been recovered from his possession.

Learned APP for the State opposes the prayer of regular bail application of the petitioner.

Considering the fact that the petitioner is in custody since 20.02.2021, charge-sheet has been submitted in this case and the petitioner, is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 101 of 2021.
