2. The petitioner apprehends his arrest in a case registered for the offence under Section 354 of the Indian Penal Code and Section 8 of the POCSO Act.

3. It is alleged that on 15.06.2023, this petitioner brought the minor daughter of the informant at a kirana shop, gave two packet of Kurkure and thereafter, touched her inappropriately.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case with an ulterior motive. He further submits that petitioner used to work in Mumbai and on the alleged date, he came to his

No.31477 of 2024(6) dt.03-01-2025 2/2 house for shradh-karm (Barkhi) of his father and while he was going to market to purchase some articles, the family members of the informant demanded some money from him and on refusal, this false and concocted case has been lodged. He further submits that no offence under Section 354 I.P.C. and Section 8 of POCSO Act is made out against the petitioner. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State and learned counsel for the opposite party no. 2 opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. VI-cum-Special Judge, POCSO Act, Khagaria in connection with Mahila P.S. Case No. 50 of 2023, G.R. No. 17 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
