6/8 CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL JUDGMENT Date : 25-09-2023 Heard Mr. Binod Kumar Singh, learned counsel appearing on behalf of the petitioners, Mr. Indu Bhushan, learned counsel for the Chapra Municipal Corporation and Mr. Majid Hussain, learned counsel for the State.

The petitioners claimed to be petty shopkeepers, who have been coming in possession of the shops, in question, in Municipal Market (Sarkari Bazar) constructed by Chapra Municipality, preferred the present writ application seeking a direction commandig upon the respondents, especially, Respondent No. 3 - Chapra Municipal Corporation, to restrain them from forcibly evicting and demolishing the existing shops of Municipal Market, which are in lawful occupation of the petitioners.

3. It is submitted that the petitioners have been continuously coming in possession of the shops, in question, for more than 4-5 decades. Earlier also, in the year 1983-1984 notices were issued by the respondent corporation to evict the shop and on being aggrieved, the shopkeepers moved before this Court and the Hon'ble Court vide order dated 16.02.1984 directed the authorities of the respondent corporation not to evict the shopkeepers forcefully and liberty was given to start

7/8 appropriate proceeding for this purpose.

4. Now, the only apprehension of the petitioners is that they may not be subjected to forcible eviction from their shops, without recourse to a legal proceeding, in view of the public notice.

Mr. Singh, learned counsel for the petitioners further drew the attention of this Court, to the order passed by learned co-ordinate Bench of this Court in CWJC No. 12027 of 2019, wherein while disposing the identical writ petition, relates to other shopkeepers of same market of the Chapra Municipality, has been pleased to hold, that any eviction shall only be done after issuing notice individually to the occupants/writ petitioners, whereafter the matter shall be taken to its logical conclusion in accordance with law.

6. Now, the relief of the petitioners is also confined to the similar protection.

Per contra, learned counsel representing the Municipal Corporation Chapra submits that in fact a decision has been taken by the Empowered Standing Committee, to construct a super market and in case the market would be constructed, shops would be allotted in favour of the petitioners, as has also been averred in paragraph 11 of the counter affidavit.

8/8 He next submits that it is obvious that eviction can be done only after issuing notice individually to the occupants/writ petitioners and in this regard, the Corporation will take initiatives in accordance with law.

8. Considering the submissions made on behalf of the parties and taking note of the order passed by the learned coordinate Bench in identical matter, the present writ application stands disposed of in terms of the order of the learned coordinate Bench passed in CWJC No. 12027 of 2019.

9. It is needless to observe that any proceeding of eviction must be preceded by issuance of notice individually to the occupants/writ petitioners before coming to its logical conclusion in accordance with law.

10. Till then, the status quo as existing today shall be maintained.
