JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Naya Ram Nagar P.S. Case No. 157 of 2017, registered under Sections 419, 420, 467, 468, 323, 504 and 506/34 of the Indian Penal Code.

The accusation is that petitioner and one Neeraj Kumar took cash of Rs.2,00,000/- to the complainant, Dhiraja Kumar Raja, for appoint on contract basis in Bihar Administrative Reforms Society, General Administrative Department, District Munger, as Executive Assistant. While after filling up the application form he appeared in examination, but the job was not provided to him. In spite of repeated requested, the money was not refunded by the petitioner and Neeraj Kumar.

Patna High Court Cr.Misc. No.51804 of 2017 (2) dt.03-11-2017 Learned counsel for the petitioner submits that, in fact, petitioner is himself unemployed and he has also applied for the said post but due to ulterior motive the present case has been lodged with false allegation.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Ist, Munger. in connection with Naya Ram Nagar P.S. Case No. 157 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
