====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-12-2021 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application, for grant of regular bail, arises out of Saraiya Police Station Case No. 753 of 2020, disclosing offences under Sections 393, 307 of the IPC and Section 27 of the Arms Act.

As per the prosecution case, on 22.11.2020 at around 9.30 a.m., the informant and his staffs were going on cash van from Chapra to Siwan and reached reached near Bakhra cold storage, one white coloured car tried to intercept the vehicle of informant and the accused persons sitting in the car started indiscriminate firing due to which driver of the cash van got firearm injury.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.38794 of 2021(2) dt.13-12-2021 2/2 petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case only as the material that he was supplying this information of movement of vehicle to other accused person. Learned counsel further submits that the petitioner has a clean antecedent and he is in custody since 09.01.2021.

Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that petitioner is in custody since 09.01.2021, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 4th-cum-Sub Judge (West), Muzaffarpur, in connection with Saraiya Police Station Case No. 753 of 2020.
