JUSTICE SANJAY PRIYA ORAL ORDER 15-11-2017 Earlier prayer for bail of the petitioners was rejected vide order dated 25.05.2017 passed in Cr. Misc. No. 23062 of 2017 and they were directed to surrender in the court below and make prayer for regular bail.
This second anticipatory bail petition has been filed on behalf of the petitioners on the ground that one of the coaccused Shankar Roy @ Kare Roy has been granted regular bail by a co-ordinate Bench of this Court on 17.08.2017 in Cr. Misc. No. 34997/2017.
From the submission of the petitioners as well as the material mentioned in the bail petition, this Court does not find any fresh ground for grant of anticipatory bail. Accordingly, the
Patna High Court Cr.Misc. No.52064 of 2017 (2) dt.15-11-2017 2/2 anticipatory bail petition of the petitioner is rejected. The petitioners may surrender before the court below and seek regular bail, which shall be considered by the court below in accordance with law without being prejudiced by this order.
