JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2018 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner is apprehending his arrest in a case for the offence registered under Sections 341, 323, 494, 406, 498(A)/34 of the IPC and Section 3⁄4 of the D. P. Act. The prosecution story, in brief, is that the accused persons including the petitioner tortured the victim due to nonfulfilment of demand of dowry. It has been submitted by learned counsels for the petitioner and the informant that the matter has already been settled between the petitioner and the informant and they have agreed to live together.

No.32473 of 2018 (3) dt.12-07-2018 2/2 Considering the submissions made on behalf of the petitioner and the informant, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A. C.J.M. XI, Motihari, East Champaran, in connection with Mahila P.S. Case No. 23 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. The parties will be at liberty to proceed in accordance with law before the learned court below in respect of withdrawal of criminal cases. On doing so, the learned court below shall consider the same and pass an appropriate order in the interest of justice.
