JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date: 14-08-2018 Learned Senior counsel appearing for the private respondents, by filing I.A.6246 of 2018, submits that since the Commissioner has cancelled selection of private respondents under order dated 8.8.2018, the order should be set aside in the instant proceedings.

The Court would find that during pendency of the instant proceedings, the Commissioner, Patna Division, Patna has taken independent decision on the independent pending claim of the petitioner regarding selection of private respondents. Order

Patna High Court CWJC No.10866 of 2014 dt.14-08-2018 2/2 dated 08.08.2018 is not the subject matter of the instant writ proceedings.

This Court, without expressing any opinion on the merits of the claim made by the petitioner or the private respondents, leaves it open for the private respondents to challenge order dated 8.8.2018, passed by the respondent Commissioner or for any other subsequent action they may be aggrieved by, in a duly constituted proceedings in accordance with law. No further order needs to be passed in the instant writ petition. The same is disposed of.
