JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 23-05-2019 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner seeks bail in connection with Amarpur P. S. Case No. 239 of 2018 registered under Section 366A/34 of the Indian Penal Code.

Considering the statement of the victim, as recorded under Section 164 of the CrPC wherein she has not uttered a word against the petitioner, who is custody since 22.01.2019, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Amarpur P. S. Case No. 239 of 2018, subject to the following conditions:-

Patna High Court CR. MISC. No. 30129 of 2019(2) dt.23-05-2019 2/2 (a) that the petitioner shall attend court in accordance with the conditions of the bond executed, (b) that the petitioner shall not commit an offence similar to the offence of the present case, and (c) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
