JUSTICE ARVIND SRIVASTAVA ORAL ORDER 14-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Karakat P.S. Case No. 116 of 2016 registered under Sections304B, 201, 120(B) of the Indian Penal Code. The informant's daughter was married with Pramod Kumar Singh. Allegedly, the petitioner used to torture the deceased for illegal demand of dowry and ultimately, she was killed on non-fulfillment of illegal demand.
It is submitted that the petitioner has falsely been implicated in this case as because, the informant has filed a petition before the learned Sub Divisional Judicial Magistrate, Bikramganj, Rohtas stating that he has filed the present case
Patna High Court Cr.Misc. No.1835 of 2017 (3) dt.14-02-2017 2/2 mistakenly because his daughter died natural death. It is further submitted that the petitioner is residing separately from husband of the deceased.
Considering the facts and circumstances of the case let the petitioner named above, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Karakat P.S. Case No. 116 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Bikramganj, Rohtas subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
