Petitioners apprehend their arrest in Patrakar Nagar P.S. Case No. 600 of 2017 instituted for the offence under Sections 406 and 420/34 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that there is no specific allegation against these petitioners of committing any misappropriation of money of the informant. In the written report the informant has alleged that one Ravi Thakur used to collect money from him in the name of depositing in the recurring deposit account. The informant was

Patna High Court Cr.Misc. No.33481 of 2018(3) dt.02-07-2018 2/3 making payment to aforesaid Ravi Thakur. The name of these petitioners have come in the FIR as the staff of Central Cooperative Bank. The informant has alleged that when he went to the aforesaid Bank he found the bank was closed and the staff were not present in the bank. It is further submitted that one of co-accused of the case has already been granted anticipatory bail by coordinate bench of this court vide order dated 23.04.2018 passed in Cr. Misc. 17589 of 2018. In the facts and circumstances of the case, prayer of the petitioners for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Patrakar Nagar P.S. Case No.

600 of 2017, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Judge-X-cum-A.C.J.M., Patna subject to the conditions as laid down under Section 438(2) Cr. P.C.

(1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioners shall cooperate in the trial and shall be present on each and every date fixed by the court and absence on two consecutive dates without proper and reasonable reason will automatically

Patna High Court Cr.Misc. No.33481 of 2018(3) dt.02-07-2018 3/3 cancel bail bond of the petitioners and (3) if petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
