The petitioner apprehends his arrest in Motihari Town P.S. case No. 51 of 2019 registered under Section 30(A), 38(i) of the Bihar Prohibition & Excise Act.

The informant alleged that he got information that petitioner had kept concealed 19. 350 liters of liquor near a temple situated in Hanumangarhi. On such, the informant went there and recovered liquor.

The learned counsel for the petitioner submits that nobody has seen the petitioner keeping the liquor near the temple situated in Hanumangarhi. The informant did not disclose the source of information from where he got this information that the petitioner had kept the liquor near temple.

No.28424 of 2019(2) dt.30-04-2019 2/2 Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that nothing has been recovered from the possession of the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VIIcum-Special Judge, Excise Act, East Champaran, Motihari in connection with Motihari Town P.S. case No. 51 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
