The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 25(1-A), 25(1-AA), 25(1-B)AC,26(i)(ii)(iii) and 35 of the Arms Act. Firearm was, allegedly, recovered from possession of other co-accused person.
Name of the petitioner transpired in the confessional statement of the arrested accused. The petitioner has stated on oath that he has got no criminal antecedent and similarly situated coaccused, namely, Md. Gulshad @ Gulo has already been allowed anticipatory bail by a Coordinate Bench of this Court vide order dated 07.07.2017 passed in Cr. Misc. No. 29850 of 2017. Considering the aforesaid facts, let the petitioner,
Patna High Court Cr.Misc. No.52803 of 2017 (2) dt.09-11-2017 2/2 above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Kharagpur Police Station Case No. 119 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
