12-06-2018 Heard Sri Surendra Kishore Thakur, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Naokothi P.S. Case No. 100 of 2016 registered for offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. At the very outset, learned counsel for the petitioner has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. By way of referring to F.I.R., learned counsel for the petitioner submits that it is a peculiar case, in which, vehicle of the mother of the petitioner was found in an accident condition on the road and subsequently, police arrived and a case was made out, as if, in the vehicle Indian make foreign liquor was concealed and it

Patna High Court Cr.Misc. No.31690 of 2018(2) dt.12-06-2018 2/2 was indicated that driver had already fled away. It has been argued that petitioner is the son of the registered owner of the vehicle and he was not having any connection with the case. Be that as it may, considering the nature of accusation and clean antecedent of the petitioner, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Rajnish Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court, Begusarai in connection with Naokothi P.S. Case No. 100 of 2016, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
