The petitioner apprehends his arrest in connection with Kalyanpur P.S. Case No. 86 of 2018 registered for the offences punishable under Section 414 of the Indian Penal Code and Section 25 (1-b)a, 26, 35 of the Arms Act. On the tiff off police apprehended three motorcycle borne criminals and recovered one loaded country made pistol from apprehended accused Dina Nath Sahni, who disclosed the name of the petitioner before the police as one of his accomplices in the occurrence.

Learned counsel for the petitioner submitted that no such occurrence as alleged ever took place. The petitioner is

Patna High Court CR. MISC. No.27011 of 2019(2) dt.30-04-2019 2/2 quite innocent and has been falsely implicated in this case. He was not apprehended on the spot. There is noting on record indicating the complicity of the petitioner in the occurrence barring the confessional statement of co-accused Dina Nath Sahni due to animosity. He has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJMIX, East Champaran, Motihari in connection with Kalyanpur P.S. Case No.86 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
