JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-06-2018 The petitioners seek bail in anticipation of their arrest in connection with Goh P.S. Case No. 114 of 2017, dated 05.09.2017, instituted for the offences punishable under Sections 147, 149, 341, 323, 354, 509, 379, 307 and 427 of the Indian Penal Code and Section 3/4 of the Prevention of Witch (Daain) Practices Act, 1999. Seventeen persons have been made accused in this case including the petitioners and there is no specific allegation against them.

No.31807 of 2018 (3) dt.29-06-2018 2/2 It has been submitted on behalf of the petitioners that the occurrence took place on 18.08.2017, but the written report regarding the same was lodged on 24.08.2017, even though the informant was saved by the police. One of the accused persons was arrested after the institution of the case and the police has submitted charge-sheet against him under various sections of the I.P.C. and Section 3/4 of the Prevention of Witch (Daain) Practices Act, 1999. It has further been submitted that one of the accused persons, viz. Yunus Ansari has been granted anticipatory bail by this Court vide order dated 22.06.2018, passed in Cr. Misc. No. 25764 of 2018.

Regard being had to the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Goh P.S. Case No. 114 of 2017.
