JUSTICE ANIL KUMAR SINHA ORAL ORDER 11-02-2021 Heard Mr. Sanjay Prasad, learned counsel for the petitioner and Mr. Gyan Shankar, learned counsel appearing for the respondent - Bihar School Examination Board, Patna. The present writ application has been filed for a direction to the respondents authorities to re-exmine all the papers of Intermediate Annual Examination, 2020 of the petitioner bearing Roll Code - 12062, Roll No.- 20040001, Registration No. R-120620118-17, Faculty- Science and to publish fresh result on the basis of the marks obtained by the petitioner.

Learned counsel for the petitioner submits that petitioner had appeared in the earlier Annual Intermediate Examination held in the year 2019 and had obtained 290 marks in 2nd Division. However, for the purpose of improvement, he

Patna High Court CWJC No.7598 of 2020(5) dt.11-02-2021 2/3 again appeared in the Intermediate Annual Examination, 2020 but the respondent - Bihar School Examination Board (hereinafter referred to as "BSEB") awarded similar marks which were awarded in the earlier Annual Intermediate Examination of 2019 and there is difference of only 01 marks. Learned counsel further submits that petitioner applied for supply of examined copy (answer sheets) of Intermediate Annual Examination, 2020 for which requisite fee has already been deposited by the petitioner with the respondent - BSEB. On the other hand, Mr.

Gyan Shankar, learned counsel appearing for the respondent - BSEB submits that petitioner has not paid the requisite fees in the mode prescribed by the respondent - BSEB and has tendered the said amount by way of demand draft, which was returned to the petitioner. This Court by its order dated 21.01.2021 had directed learned counsel for the respondent - BSEB to seek instruction as to whether the answer sheets of the petitioner is still pending with the BSEB or not.

In view of the aforesaid facts and circumstances, this writ application is disposed of with a direction to the respondent no. - 2 / Secretary, BSEB to supply the examined copy (answer sheets) of the petitioner of Intermediate Annual Examination, 2020 within a period of four weeks subject to payment of requisite fees by the petitioner as aforesaid.
