The petitioner seeks bail in a case registered for the offence punishable under Sections 363, 366 and 367 of the Indian Penal Code.
Allegation against the petitioner along with others is of kidnapping the grand daughter of the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits date of occurrence is 18.11.2019 but the FIR has been lodged on 21.11.2019 after delay of three days without any valid explanation. He submits that victim had love affairs with someone else and as per her own volition she fled away from her house. He submits that during the course of investigation, no ocular or convincing evidence has come
Patna High Court CR. MISC. No.28674 of 2020(8) dt.08-03-2021 2/2 against the petitioner. He further submits that petitioner is languishing in judicial custody since 13.01.2020. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Runnisaidpur P.S. Case No. 491 of 2019 pending before the court of the learned Additional Chief Judicial Magistrate-VI, Sitamarhi. However, learned court below is directed to expedite the trial.
