The petitioner apprehends his arrest in Banka P.S. Case No. 634/2016, registered for the offences punishable under Sections 341, 323, 427, 420, 467, 468 and 471 of the Indian Penal Code.
The informant alleged that the petitioner forcibly and under threat of life forced the father of the informant to execute sale deed with regard to the land situated in Mauja Domuhan, Sanghpur and Chamreli.
Learned counsel for the petitioner submits that the petitioner happens to be nephew of Mohan Ram Dokaniya. On the same day Mohan Ram Dokaniya executed a sale deed with regard to the land situated in urban area of Banka in favour of Bajrang
Patna High Court Cr.Misc. No.39106 of 2016 (3) dt.27-10-2016 2/2 Kumar Sultania, a businessman of Deoghar. The sale deed was executed after receiving consideration amount and at best the informant has got remedy in civil suit. Now the case is compromised and a compromise petition is also filed. Learned counsel for the informant supported the factum of compromise between the parties.
Considering the nature of allegation made against the petitioner and the fact that the case is compromised, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 634 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
