The petitioner seeks bail in Sri Krishnapuri P.S. Case No. 08 of 2019, instituted for the offence under Section(s) 379 of Indian Penal Code. Subsequently, Section 411 of the Indian Penal Code was added.
Counsel for the petitioner submits that petitioner is not named in the written report. He has clean antecedent. His name has come during investigation merely on suspicion. Counsel for the petitioner further submits that the date of occurrence is 6.1.2019 and First Information Report has been lodged on 8.1.2019 i.e. after lapse of two days. It is mentioned in the seizure list that alleged
Patna High Court CR. MISC. No.27963 of 2019(2) dt.30-04-2019 2/2 vehicle was recovered from parking in front of Pandui Palace, Boring Road. Petitioner was shown sitting on the aforesaid vehicle.
Petitioner is in custody since 18.01.2019 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Praveen Kumar Singh, learned Judicial Magistrate, 1st Class, Patna, in connection with Sri Krishnapuri P.S. Case No. 08 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
