Petitioner apprehends arrest in a case registered for the offence punishable under Sections 302/34 of Indian Penal Code and Section 27 of Arms Act.
As per prosecution case, all the FIR named accused persons committed murder of brother of the informant. It is further alleged that the FIR accused persons prior to the incident threatened the brother of the informant on mobile. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that petitioner is not named in the FIR and no suspicion has been raised against this petitioner by the informant. Moreover, there is no eye witness of the occurrence. Petitioner has got clean antecedent.

No.28912 of 2022(3) dt.21-11-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, IV, Madhepura in Kumarkhand P. S. Case No. 87 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
