This application, for grant of regular bail, arises out of Karamchat Police Station Case No. 19 of 2021, disclosing offences under Section 30(a), (d)/36 of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The allegation, as per the prosecution story is that a total quantity of 4 kgs. of Java Mahua and some rotten mahua for manufacturing liquor, have been recovered from the chamber of co-accused, Shyamlal.

It is submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of the petitioner and he has falsely been implicated in this case having clean antecedent. Investigation is complete and

Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that petitioner is in custody since 20.03.2021, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Kaimur at Bhabua, in connection with Karamchat Police Station Case No. 19 of 2021.
