Irrespective of the decision 10.08.2015 passed by the learned single Judge dismissing the writ application, this Court takes notice of the fact that there is a title suit pending between the parties, which is Title Suit No.51 of 2009 before the Court of SubJudge-I, Muzaffarpur. Looking at the nature of the relief prayed for therein, it will be in the interest of the contesting parties that the
Patna High Court LPA No.663 of 2016 dt.15-02-2018 2/2 suit is allowed to be concluded at the earliest and the right, title and interest shall flow therefrom which will govern the issue. With the observations as above, this Letters Patent Appeal is dismissed.
