The petitioner apprehends his arrest in Ekangarsarai P.S. Case No. 72 of 2018 instituted for the offences punishable under Sections- 341, 323, 498(A), 504 and 506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is the husband of the informant and he is ready to keep her wife with full honour and dignity. Annexure 3 is a letter sent by the informant to the General Manager, Brahmos, Aerospace, Delhi - Cantt indicating that she made inappropriate allegation against the petitioner, who is Mechanical Engineer in the Ministry of Defence. Whereas, wife is a teacher, appointed on contract basis by the State Government. Learned counsel for the informant also informed the Court that informant is also willing to live with the petitioner subject to keeping her with full dignity and honour.

No.32179 of 2018 (2) dt.23-05-2018 2/2 Having considered the facts and circumstances, the petitioner, named above, is directed to be released on provisional anticipatory bail for six months so in the event of his arrest or surrender in the court below within four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ekangarsarai P.S. Case No. 72 of 2018 to the satisfaction of learned ACJM, Hilsa is directed to be released subject to condition as laid down u/S 438(2) of the Cr.P.C. and also with a further condition that thereafter petitioner will take back her and will keep his wife with dignity and honour and the learned court below will monitor the relationship during the period of six months and finding the matrimonial relation cordial only the provisional bail shall be confirmed, which may be reflected by filing compromise petition or even if the wife refuses to go back with the husband without any cogent reason.
