The matter has been taken up through video conferencing.

The petitioner seeks bail in Sakra P.S. case No. 03/2019 registered u/s 392 of the IPC.

The informant lodged the case against unknown for looting of his motor cycle. During the course of investigation, the name of petitioner surfaced in the case in the confessional statement of co-accused. The petitioner was also seen roaming around the place of occurrence.

The learned counsel for the petitioner submits that prayer of petitioner for bail was earlier rejected by this court vide order dated 13.01.2020 passed in Cr. Misc. No. 80794/2019

Patna High Court CR. MISC. No.25143 of 2020(2) dt.23-09-2020 2/2 on the ground that petitioner has got criminal antecedent but now the petitioner has remained in jail for more than one year. The petitioner is in custody since 09.08.2019. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner has remained in jail for more than 13 months on the material that the name of the petitioner was surfaced in the case in the confessional statement of co-accused, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IX (East), Muzaffarpur in connection with Sakra P.S. case No. 03/2019.
