The petitioners seek pre-arrest bail in connection with Agiaon (Garhani) P.S.Case No. 85 of 2017 registered under Sections 353, 380, 409 and 454/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that even if the entire allegations made in the First Information Report are taken to be true, the ingredients of the offences punishable under Sections 409 and 454 of the Indian Penal Code would not be attracted. He submitted that the petitioners are Anganbari Supervisors and due to some personal grudge the Child Development Project Officer, Agiaon has made
Patna High Court Cr.Misc. No.58641 of 2017 (2) dt.12-12-2017 2/2 frivolous allegations against them. He also submitted that the petitioners have got roots in the society and have no criminal antecedent.
Learned counsel for the State has opposed the prayer for grant of pre-arrest bail.
Considering the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Bhojpur at Ara in connection with Agiaon (Garhani) P.S.Case No. 85 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
