JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Tekari P.S. Case No. 438 of 2015 registered under Section-135 of the Electricity Act.

Petitioner is said to have been stealing electric energy by fixing TOKKA in the main line and, accordingly, he caused damage to the electricity department to the tune of Rs. 41,716/- but submission on behalf of petitioner is that one coaccused namely Surendra Bind @ Surendra Kumar @ Surindar Bind has already been admitted to anticipatory bail by a

Patna High Court Cr.Misc. No.524 of 2017 (2) dt.13-01-2017 2/2 coordinate bench of this court subject to condition of 50 % deposit of the loss amount and the petitioner is also ready to deposit 50% of the loss amount.

In view of the aforesaid submissions as well as facts and circumstances of the case, this anticipatory bail petition is allowed and it is ordered that the petitioner named above, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Tekari P.S. Case No. 438 of 2015 to the satisfaction of learned Special Judge (Electricity), Magadh Area, Gaya. subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code with further condition that within two months from the date of furnishing bail bonds, the petitioner shall deposit 50% of the loss amount with the concerned court and if, he fails to do so, the concerned court shall be at liberty to cancel the bail bonds of the petitioner.
