The petitioner is apprehending his arrest in connection with Benipatti P.S.Case No.43 of 2018, registered for offences punishable under Sections 409 and 34 of the I.P.C. Petitioner is Ex- Mukhiya and allegation against her is that she in connivance with Panchayat Sachiv defalcated an amount of Rs. 3,85,595/- meant for fixing tube well and solar light under Gram Panchayat Kataiya.
It has been submitted on behalf of the petitioner that she has falsely been implicated in this case, which will appear from the fact that the allegation is of the year 2011, whereas the F.I.R has been lodged in the year 2018. It has also been submitted that the specific allegation has been levelled against the Panchayat
Patna High Court Cr.Misc. No.33191 of 2018 (2) dt.06-06-2018 2/2 Sachiv and not against the petitioner, which is evident from the letter issued by the Block Development Officer, Benipatti. Considering the facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Benipatti, Madhubani, in connection with Benipatti P.S.Case No.43 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
