JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-07-2019 This application has been filed for modification of the order dated 1.5.2018 passed in Cr.Misc.No.14093 of 2018 by which petitioner was directed to surrender within a period of four weeks along with a Bank Draft of Rs.31,278/- payable to NBPDCL.

It has been submitted by learned counsel for the petitioner that in title portion of the said order in place of District Madhubani, Aurangabad has been mentioned. It has further been submitted that petitioner was directed to pay 50% of the total electricity dues.

Having considered the fact that order has been passed on 1.5.2018 and after almost a year this modification application

Patna High Court CR. MISC. No.45238 of 2019(2) dt.24-07-2019 2/2 has been filed and also considering the fact that petitioner has been granted conditional bail, I am not inclined to interfere with the earlier order.

However, the petitioner is directed to surrender and pray for regular bail with the submission that he is ready to pay 50% of the total due amount, which shall be considered by learned court below on its own merit and, if possible, to be disposed of on the same day.

With the above observation, this application is disposed of.
