JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 05.12.2016 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with a case registered under section 307 and other minor sections of the Indian Penal Code.

Informant was got renovating his house but in the meantime, FIR named accused including petitioners started assaulting the informant and when his family members came there, they were, too, assaulted.

Learned counsel for the petitioners drew my attention towards written report and submitted that there is allegation of assault against co- accused Khattar Das and Arvind Kumar and so far as petitioners are concerned, it is wrongly stated that they made attempt to assault the informant and his family members.

Patna High Court Cr.Misc. No.44581 of 2016 (2) dt.05-12-2016 So, the aforesaid fact goes to show that the petitioners had not caused any injury to any person.

Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Sri S. Ram, Judicial Magistrate, Ist Class, Supaul/ concerned court in Triveniganj P.S. Case no. 17/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
