JUSTICE ARVIND SRIVASTAVA ORAL ORDER 09-01-2017 Heard learned counsel for the petitioners and learned counsel for the State.
Petitioners apprehend arrest in connection with Deep Nagar P.S. Case No. 101 of 2016 registered under Sections- 498A and other allied sections of the Indian Penal Code.
The allegation against the petitioners, who are members of in-laws family of the daughter of the informant, is of assault and attempt to kill on account of non-fulfillment of additional demand of dowry.
Learned counsel for the petitioners submits that informant's daughter herself fled away with Akash Kumar
Patna High Court Cr.Misc. No.49659 of 2016 (3) dt.09-01-2017 2/2 without informant to petitioners. It is further submitted that in her statement under section 164 Cr.P.C. informant said that she is residing at the house of Akash Kumar and she gave birth to a child after nine month.
Considering the facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Nalanda at Biharsharif in connection with Deep Nagar P.S. Case No. 101 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
