The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on information having been received a raid was conducted and a total of about 485 litres of IMFL was recovered hidden in the field near the house of the petitioner. As per information the said liquor belong to the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the person or possession of this petitioner who has been falsely implicated in the case. Even as per the FIR the alleged place of recovery is

Patna High Court CR. MISC. No.38675 of 2021(2) dt.07-01-2022 2/2 an open paddy filed not belonging to the petitioner. The petitioner is in custody since 27.4.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, charge sheet having been submitted in the case and the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Special Case Excise no. 2372 of 2019 (arising out of Bihta P.S. Case no. 234 of 2019) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna.
