JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Sono P.S. Case No. 146 of 2012, dated 24.10.2012, instituted for the offences punishable under Section 394 of the Indian Penal Code.
Learned counsel for the petitioner submits that he has not been named in the F.I.R. and his implication in the present case is only on the basis of confession of co-accused with whom he has serious enmity. It has further been submitted that in two others cases in which the petitioner has been made accused is of the years 2012 and 2013 and in
Patna High Court Cr.Misc. No.33439 of 2018 (4) dt.04-07-2018 2/2 both the cases, he is on bail.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jamui in connection with Sono P.S. Case No. 146 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
