2. The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 8(c) and 21(b) of the NDPS Act.
3. The case of the prosecution is that from a motorcycle, altogether 5.2 grams of smack was recovered.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Learned counsel for the petitioners has submitted that nothing has been recovered from the possession of the petitioners.

No.28279 of 2026(2) dt.04-05-2026 2/2 Though the quantum of contraband which has been recovered is slightly more than small quantity but is much less than commercial quantity as per NDPS Act. A statement has been made in para-3 of this petition that the petitioners have got no criminal antecedent. Moreover, they are languishing in judicial custody since 15.12.2025.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Sikti P.S. Case No. 214 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cumthe Special Judge NDPS Act, Araria.
