The petitioners apprehend their arrest in Brahmpur(Krishna Brahm) P.S. Case No.190 of 2020 registered under Sections 147, 149, 341, 323, 337, 353 of Indian penal Code, Section 44/45 of Bihar Prohibition and Excise Act and Sections 30(a)/30(d) of Bihar Prohibition and Excise (Amendment) Act.

Patna High Court CR. MISC. No.25623 of 2020(2) dt.15-10-2020 2/2 The police raided the Mushar Toli and arrested nine persons and from whose house, small quantity of liquor weighing about 15 litres was recovered. The police alleged that 218 litres of half prepared liquor was also recovered. The learned counsel for the petitioners submits that petitioners were not present in the village. They are labours and they were working outside the village. Ladies were apprehended. For the recovery of small quantity of liquor, nine persons were apprehended.

Taking into consideration the facts aforesaid and nature of allegation made against the petitioners, let the petitioners, above named, in the event of their arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.D.J. II-cum-Special Judge, Excise, Buxar in connection with Brahmpur(Krishna Brahm) P.S. Case No.190 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
