This application, for grant of regular bail, arises out of Paroo Police Station Case No. 104 of 2021, disclosing offences under Section 30(a) of the Bihar Excise Act. The allegation, as per the prosecution story is that a total quantity of 260.92 litres of illicit liquor has been recovered from the Sudha Centre of the petitioner.

It is submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of the petitioner and he has falsely been implicated in this case having clean antecedent. Investigation is complete and petitioner is in custody since 29.03.2021.

Having regard to the submissions made by the parties

Patna High Court CR. MISC. No.38760 of 2021(2) dt.13-12-2021 2/2 and taking into consideration the materials on record and the fact that petitioner is in custody since 29.03.2021 having no criminal antecedent, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise Act), Muzaffarpur, in connection with Paroo Police Station Case No. 104 of 2021, G.R. No.680 of 2021.
