Petitioner apprehends arrest in connection with Malsalami P.S. Case No.257 of 2016 registered for the offence punishable under Section 7 of the E.C. Act and Sections 420, 120(B)/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner is engaged in the business of wheat, rice and flour since long. He had only used gunny bags having mark of FCI and that do not make out any offence. It is further submitted that the entire case is based on suspicion. Petitioner is a man of clean antecedent.

Considering the facts and circumstances of the case

Patna High Court Cr.Misc. No.32684 of 2018 (2) dt.05-06-2018 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Patna City, Patna in connection with Malsalami P.S. Case No.257 of 2016 subject to the conditions laid down under Section 438(2) Cr.P.C.
