Mr. Navin Kumar Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 13-12-2022 Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State through virtual Court proceedings.

The petitioner seeks bail in connection with Mansi P.S. Case No.36 of 2022 registered for the offence under Sections 394 of the Indian Penal Code.

The accused/petitioner is not named in the F.I.R. and

2/4 is in custody since 09.02.2022.

The allegation against the petitioner is to commit robbery and while committing so, taken away cash worth Rs. 1,75,000/- (Rupees One Lakh Seventy Five Thousand) and other available documents like Aadhar card, PAN card etc., belonging to the informant.

Learned counsel appearing on behalf of the petitioner submitted that petitioner was not named in the F.I.R., whereas subsequently on the basis of suspicion, his name surfaced in the present case. It is further submitted that recovery of Aadhar card and PAN card alleged to be shown from the possession of this petitioner, which is only to make allegations more convincing. It is also submitted that petitioner was not put on T.I.P. and moreover, recovered documents were also not verified from the competent issuing authority regarding their genuineness. It is also pointed out that petitioner is involved in 4 cases, where he is on bail and in maximum of these cases his name surfaced on the basis of suspicion as of present case. While concluding the argument, it is submitted that investigation of this case has been completed, for which, charge-sheet has already been submitted, as such, there is no chance of tampering with the evidence. Learned APP appearing on behalf of the State, while

3/4 opposing the prayer of bail submitted that Aadhar card and PAN card of the informant was recovered from the possession of this petitioner.

In view of the facts and circumstances as mentioned above as recovered documents were not verified from the competent issuing authority as regard to its genuineness coupled with the fact that chargesheet has already submitted, where petitioner is in custody since, 09.02.2022, let above named petitioner directed to be released on bail in connection with Mansi P.S. Case No.36 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria/concerned court, subject to following conditions :- (I) That accused/petitioner shall cooperate in the trial and shall be physically present on each and every date before the Trial Court till conclusion of the trial and exemption from physical appearance be allowed by the Trial Court, only on medical ground of the petitioner, duly supported by the documents.
