The Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code and Section 135 of the Electricity Act. Allegation against the petitioner is that he was using electricity within business premises without proper connection and caused loss of Rs.5,00,000/- to the department. Petitioner has not produced any supporting document showing that he has taken seasonal connection for the period
Patna High Court Cr.Misc. No.49415 of 2016 (3) dt.17-01-2017 2/2 when raid was committed.
Considering the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner in connection with Sasaram Town (M) Police Station Case No. 153 of 2016 pending in the court of learned Chief Judicial Magistrate, Rohtas at Sasaram/Successor Court. Accordingly, the prayer for anticipatory bail is rejected.
