The petitioner apprehends his arrest in connection with Nawada Town P.S. Case No.634 of 2016 registered under Sections 447, 341, 323, 504, 325, 354(B) and 379/34 of the Indian Penal Code.
The accusation is that six persons, named in the F.I.R., including the petitioner along with 3-4 unknown variously armed with weapons came at the door of the informant and started to abuse saying that as to why he has given the evidence in the court. When the informant made protest then Nilratan Kumar alias Mantu ordered his brothers Sanjeet Kumar and Sujit Kumar
Patna High Court Cr.Misc. No.60636 of 2017 (2) dt.14-12-2017 2/3 (petitioner) to assault him entering into the house. Thereafter, Sanjeet Kumar caused blood oozing injury at the head of the informant through iron rod. At that time, this petitioner torn the clothes of the sisters of the informant with bad intention and Sanjeet Kumar snatched the gold chain of the mother of the informant worth Rs.60,000/-.
Learned counsel for the petitioner submits that there are several cases pending in between the petitioner and the informant, due to that reason, on the date of the occurrence, the informant and his other family members came at the house of the petitioner and caused injury to the petitioner and his family members regarding which on the basis of the written report of the co-accused Sanjeet Kumar, the brother of the petitioner, Nawada Town P.S. Case No.633 of 2016 was instituted on 10.11.2016 against the informant and others. Only to save his skin, the informant has lodged this case with false allegation. The petitioner has no criminal antecedent.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the
Patna High Court Cr.Misc. No.60636 of 2017 (2) dt.14-12-2017 3/3 Chief Judicial Magistrate, Nawada, in connection with Nawada Town P.S. Case No.634 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
