The petitioners are apprehending their arrest in connection with Choutham P.S.Case No.11 of 2018 corresponding to G.R.No.215 of 2018 registered for offences punishable under Sections 366(A)/34 of the Indian Penal Code.
Allegation against the petitioners is of kidnapping the minor daughter of the informant.
Submission of the learned counsel for the petitioners is that they being father and brother have been implicated in this case and no specific allegation has been attributed against them. Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail on the ground
Patna High Court Cr.Misc. No.32996 of 2018 (3) dt.17-07-2018 2/2 that in her statement, the girl has also named the petitioners also and the person who have surrounded and taker her. . Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit.
