JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 17-11-2017 Heard learned counsel for the petitioners. Despite repeated calls, nobody appears on behalf of the State. The petitioners seek pre-arrest bail in connection with Bidupur P.S. Case No. 175 of 2017 registered under Sections 143, 144, 145, 341, 323, 186, 353, 332, 333, 504 and 506 of the Indian Penal Code.

It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.51172 of 2017 (2) dt.17-11-2017 petitioners that from perusal of the FIR itself, it would appear that more than 71 persons including several ladies were sitting on dharna in order to raise protest against the inaction of administrative officers of the district. He submitted that there is no other allegation that the accused persons either damaged public property or caused any violence during protest. He submitted that so far as the petitioners are concerned, they have never ever been made accused in any other criminal case. Having regard to the nature of allegation and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 175 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
