Petitioner filed this petition for modification of the order dated 14.09.2016 passed in Cr. Misc. 30085/2016. The prayer for anticipatory bail of the petitioner was rejected vide order dated 14.09.2016 passed in Cr. Misc. 30085/2016 and it was observed that if the petitioner deposits Rs. 2,80,840/- within two months and surrender in the court below. Learned court below shall consider the prayer for regular bail of the petitioner taking into consideration that the money has already been deposited and disposed of the bail petition of the petitioner on the same day. It is submitted that the petitioner sought account number from the department in which the money was to be deposited. The same was furnished to the petitioner on 17.11.2016

Patna High Court Cr.Misc. No.51760 of 2016 (2) dt.18-01-2017 2/2 and immediately thereafter the petitioner deposited the entire amount on 18.11.2016.

It appears that the petitioner has already deposited the amount and if the petitioner surrenders in the court below, learned court below shall consider the regular bail of the petitioner taking into account that money withdrawn by the petitioner as salary has already been deposited.

With this observation this modification petition is dismissed.
